2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. By accessing or using GhostSwap, you represent and warrant that:

  • You are not located in, or a resident of, any jurisdiction subject to comprehensive sanctions, including but not limited to North Korea, Iran, Syria, Cuba, and the Crimea, Donetsk, and Luhansk regions.
  • You are not listed on any applicable sanctions or restricted persons list.
  • Your use of GhostSwap complies with all laws and regulations applicable in your jurisdiction.

3. Services Provided

GhostSwap provides a non-custodial cryptocurrency swap interface that allows users to exchange cryptocurrencies across multiple blockchains. Transactions are processed through licensed third-party liquidity and processing partners.

GhostSwap does not hold, store, or manage cryptocurrency on behalf of users. You are solely responsible for managing your own wallet and private keys. GhostSwap is not responsible for any loss or damage arising from the use of any wallet or the loss of private keys.

4. Compliance and Verification

All transactions processed through GhostSwap are subject to automated AML (Anti-Money Laundering) screening and sanctions compliance checks conducted by our licensed processing partners.

In certain cases, including but not limited to transactions that trigger compliance thresholds or involve flagged wallet addresses, you may be required to complete identity verification (KYC) before a transaction can proceed. Failure to complete requested verification may result in the transaction being delayed, suspended, or cancelled.

GhostSwap and its processing partners reserve the right to block, freeze, or reject any transaction that is flagged by compliance systems.

5. User Responsibilities

When using GhostSwap, you agree to:

  • Maintain Security: Secure your device, wallet, and private keys. GhostSwap is not responsible for lost, stolen, or compromised wallets.
  • Comply with Applicable Laws: Comply with all applicable laws and regulations in your jurisdiction, including tax, anti-money laundering, and sanctions laws.
  • Provide Accurate Information: If identity verification is requested, provide truthful and accurate information.
  • Acknowledge Risks: Accept the risks associated with cryptocurrency transactions, including price volatility, regulatory changes, and technology-related issues.

6. Prohibited Activities

You agree not to use GhostSwap to:

  • Engage in any fraudulent, illegal, or unauthorized activity.
  • Launder money, finance terrorism, or evade sanctions.
  • Process proceeds of criminal activity.
  • Attempt to hack, overload, or disrupt the platform or its infrastructure.
  • Circumvent or attempt to circumvent any compliance measures, including AML screening or KYC requirements.
  • Engage in any activity that violates applicable laws or regulations.

GhostSwap reserves the right to immediately suspend or terminate access and report activity to the relevant authorities if any prohibited use is suspected.

7. Privacy and Data

GhostSwap does not require users to create an account for standard swap transactions. Information collected during the use of the service is limited to what is necessary for the operation of the platform and compliance with applicable legal obligations.

Where identity verification is completed, such data is processed and retained by our licensed processing partners in accordance with their privacy policies and applicable data protection regulations.

8. Transaction Fees

GhostSwap charges fees for cryptocurrency swaps, which are included in the transaction rate displayed before confirmation. Fees may vary depending on network conditions, swap amount, and the currencies involved. By confirming a transaction, you agree to the fees displayed at the time of confirmation.

9. Risks and Disclaimers

Cryptocurrency Volatility: The cryptocurrency market is highly volatile. Prices can fluctuate significantly between the time a transaction is initiated and when it is completed. GhostSwap is not responsible for any losses due to market fluctuations.

Technology Risks: The platform relies on blockchain networks and internet infrastructure, which may experience downtime, congestion, security incidents, or errors. GhostSwap does not guarantee uninterrupted or error-free access to the service.

Third-Party Services: GhostSwap relies on third-party processing partners and blockchain networks that are outside of our direct control. GhostSwap is not liable for failures, delays, or errors caused by third-party services or blockchain networks.

11. Indemnification

You agree to indemnify and hold harmless GhostSwap, its operators, affiliates, officers, directors, employees, partners, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising out of or related to:

Termination does not affect any rights or obligations accrued prior to the termination date.
